ВИНИКНЕННЯ СЕРЕДНЬОВІЧНИХ МІСТ ЯК ФЕНОМЕН ПРАВА

У статті висунута ідея про можливість розглядати само по собі місто як особливий правовий феномен. В основі лежить антропологічне визначення міста та розуміння права через правосвідомість. Обґрунтування включає два моменти. По-перше, місто являє собою принципово новий тип соціальних зв’язків, відмінних від традиційних родових і племінних. З’єднання разом чужих по народженню і роду людей вимагає розвитку норм взаємодії, в основі яких лежить визнання іншого (чужого) рівним собі. По-друге, джерелом народження міського права виступає організація міської території, за допомогою вибудовування горизонтального і вертикального вимірювань для поселення. Обидва моменти виявляються можливі для ранніх етапів розвитку людського суспільства завдяки переосмисленню (універсалізації) релігії. Місто виявляється свого роду «перехрестям» фрагментів старих правових систем, і на їх основі виникає принципово нова форма осмислення громадянином міста власного соціального буття, свого статусу в бутті. Міське право постає як форма вираження нової самосвідомості громадянина і його іншого розуміння свого місця і функції в універсумі.Посилання
